Terms of Service

These terms govern your use of AgentxSeller, a service operated by Taigers LLC ("Taigers", "we", "us") at agentxseller.com. By creating an account or installing AgentxSeller on a connected store, you agree to them. Part B is a Data Processing Addendum and forms part of this agreement.

1. What AgentxSeller does

AgentxSeller connects to the sales and marketing accounts you choose (Shopify, Google, Amazon) and gives you one place to see where your traffic comes from, what it earns, and to act on it: publishing content, managing products and stock, processing orders, and reviewing advertising and search performance. Which features are available to you depends on the accounts you connect and the plan you are on.

2. Your account

• You are responsible for keeping your login credentials secure and for activity under your account.
• You must have the authority to connect the accounts you connect, and to permit AgentxSeller to act on them.
• You may disconnect any account at any time. Doing so stops us collecting new data from it.

3. Actions AgentxSeller takes on your behalf

AgentxSeller can write to your connected accounts. Some of those actions cannot be undone, and you should treat them as your own:

• Publishing, editing and rewriting content on your store.
• Changing product titles, descriptions, prices and stock.
• Creating shipments, attaching tracking numbers, and emailing your customer that an order has shipped.
• Issuing refunds, cancelling orders, and capturing authorised payments.

Actions that move money or reach a customer are shown with their consequence and require your confirmation. Automatic actions run only for the features you switch on. We keep a record of what AgentxSeller did to your listings and orders, which you can read in the product.

4. AI-generated content

AgentxSeller uses AI to draft content and to suggest changes. Generated text can be wrong. You are responsible for what is published under your brand, and we recommend using the draft-first setting where accuracy matters. Content published to your store belongs to you.

5. Fees

Paid plans are billed monthly in advance. Plans for Shopify stores are billed through Shopify Billing and appear on your Shopify invoice; other plans are billed through our payment processor. Fees are non-refundable except where required by law. Cancelling stops future charges; it does not refund the current period.

6. Acceptable use

Do not use AgentxSeller to publish unlawful, deceptive or infringing content, to circumvent the terms of a connected platform, or to process personal data you have no right to process. We may suspend an account that does.

7. Availability and changes

We work to keep AgentxSeller available but do not guarantee uninterrupted service. Connected platforms change their APIs, and features that depend on them may change or stop. We will tell you about material changes to the service or to these terms by updating this page and, where the change is significant, by email.

8. Termination

You may stop using AgentxSeller and delete your account at any time. On termination we revoke the credentials we hold and delete your data as described in Part B, clause 8.

9. Warranties and liability

AgentxSeller is provided "as is". To the extent permitted by law we exclude implied warranties, and our total liability for any claim arising from the service is limited to the fees you paid us in the twelve months before the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded.

10. Governing law

These terms are governed by the laws of the State of California, United States, and the courts of that jurisdiction have exclusive jurisdiction over any dispute.

1. Roles

For personal data belonging to your customers and site visitors, you are the controller and Taigers LLC is your processor. For your own account data (your name, email, billing details) we are the controller, and our Privacy Policy describes that.

2. Scope of processing

• Subject matter: providing the AgentxSeller service to you.
• Duration: for as long as your account is active, subject to clauses 7 and 8.
• Nature and purpose: displaying your orders, calculating what each earned, creating shipments, contacting customers about their own orders at your instruction, and the content and analytics features you use.
• Categories of data subject: your customers and visitors to your store.
• Types of personal data: name, email address, phone number, shipping address, order history, and site-visit measurements.

3. Our obligations

• We process personal data only on your documented instructions, which include your use of the product's features, unless a law requires otherwise.
• We do not sell personal data, use it for advertising, use it to profile your customers, or use it to train AI models.
• We do not send your customers' personal data to our AI provider.
• Everyone with access to personal data is bound by confidentiality.
• We process the minimum needed for the features you use.

4. Security

Data is transmitted over HTTPS. Every stored credential is encrypted at rest. Access to production systems is limited to the people who operate the service and is logged. Test and production data are kept separate. We maintain a written incident response procedure.

5. Sub-processors

You authorise the following sub-processors. We will give you notice before adding a new one, and you may object.

• Amazon Web Services: hosting and database storage.
• Anthropic: AI content generation. It receives your brand configuration and article text. It does not receive your customers' personal data.
• Stripe: payment processing for plans not billed through Shopify. It receives your billing details, not your customers' data.

6. Data subject requests and breaches

• We assist you in responding to access, correction and erasure requests. Shopify's customers/redact and customers/data_request webhooks are handled automatically; see the Privacy Policy, clause 11.
• If we become aware of a personal data breach affecting your data, we will notify you without undue delay and in any event within 72 hours, with what we know and what we are doing about it.

7. Retention

Orders older than 24 months are de-identified automatically: the customer's name, email, phone and shipping address are removed, and the order number, line items and totals remain so your own accounting is intact. This runs on a schedule rather than on request.

8. Deletion on termination

When you disconnect a store or close your account, we revoke the credentials we hold and delete the personal data we processed for you, except where a law requires us to keep it. Content already published to your own store stays in your store.

9. International transfers

Our systems are hosted in the United States. Where you are in the European Economic Area or the United Kingdom, transfers are made on the basis of the applicable Standard Contractual Clauses, which are incorporated into this addendum by reference.

10. Audit

On reasonable written request, and no more than once a year unless a regulator requires otherwise, we will provide the information needed to demonstrate compliance with this addendum.
